Overview
On June 22, 2023, Legaltech News quoted partner Tod Cohen in an article titled, "Despite Federal Regulations, States Likely to Tread Their Own AI Regulatory Path." The article discusses current federal regulations concerning AI and states’ own AI-specific laws, specifically their approach to that legislation. Many states have recently introduced legislation regarding AI, including Connecticut, New York and Colorado. A new law in Connecticut tackles automated decision-making and personal data privacy which targets state agencies and seeks to prevent discriminatory outcomes.
Cohen noted that legislation in the US will tackle regulating the government's use of AI, mitigating outcomes or pushing for an understanding of the technology; while the European Union is trying to regulate the technology itself. He said: "I'd say those are the four areas that you see regulatory activities, and it's natural that vacuums are filled and the states are taking steps. I don’t think that they are in any way, unique outliers, but much more of a natural progression that you’re seeing."
